greenhouse size

hi ,i have put a 10/8 greenhouse up on my council run allotment,2 weeks later i have recieved a letter from parish councilers stating revised rules that greenhouses and sheds must not be bigger than 8/6,and that i must remove it.IM NOT HAPPY !

Dear Pezzer1, unless it is in writing and people have been imformed about the changes, i think you should try and argue your case. They can't just revise the rules without letting anyone know.

Was there any stipulation about the size of greenhouse you could have on your allotment when you were given the lease? If not, then I don't think the Parish Councillors are within their rights in asking you to demolish it. As you say it's the PARISH Council who are asking for the demolition, I think you should go to the next level and contact the District or County Council Planning Department for your area and ask what their regulations are. In any case, if they are revising the rules, I'm not sure that they can be applied retrospectively, otherwise they could say that revised planning rules dictate that in future no houses will be allowed to have more than three bedroooms. That doesn't mean that all 4 bedroom houses would have to be demolished. Tell them you will seek legal advice to see if the have the power to implement such a new regulation retrospectively. My guess is that they don't, if there is nothing in your allotment lease contract. If they're as dumb as some of the parish councillors in our area they probably don't know whether they have the legal power to implement such a rule or not. Challenge them and don't give in without a fight. And get your fellow allotmenteers on board for a protest (unless one of them has actually complained about it behind your back).
We have restictions as to size on our site too....I wrote to the Council asking for permission to erect a 12 x 8 greenhouse and they wrote back highlighting how it should be erected....I went ahead
The house has been on site for four years now and last year I put up a 10 x 8 on my adjacent half plot
I believe our Council operate that within reason and providing the plot is worked well plus its kept in good condition they will make allowances
All we want is a 'jobsworth' charactor to take over when our site officer retires and we could be in trouble

Hi, re greenhouse, if you belong to the Nat allot assoc, try them for advice, if in your favour mention that you have their backing when you appeal, most of these small time Hitler's then tend to back down.
