I did send Pa Snip a pm of my two issues. I often walk on a farmers field to let my dog swim in the river, there is no public access but I have the farmer's permission. The sporting rights are separate from the land ownership and the guy with the rights abusively challenged me the other evening saying I had no right to be there. I said it was nothing to do with him as I had the landowner's permission. Unfortunately as my garden was created from farmland that the same person has the shooting rights for he can technically shoot my garden, he never has done but as retaliation for the confrontation by the river he now says he will. I suppose he could also release a batch of his birds in the garden which would give me Monika's problem. I am trying to find out what he can and cannot do in a garden near a residence. As far as I can make out there is little legal protection so I have referred it to the British Association for Shooting and Conservation as they have a members' code of practice which seems to suggest common sense should prevail. It would be nice to see the feudal law changed which allows for someone to shoot over freehold land without the owner's consent, perhaps I should raise the issue while the leasehold/ground rent issue is in public eye.

Geoff, I,m ignorant on sporting firearms codes of practice but wonder whether there isn't any crossover with normal legislation regarding threatening behaviour towards a member of the public using a firearm. I'm assuming the individual concerned may still need to hold a firearms licence unless certain sporting guns are exempt. I wonder whether a quiet word with a senior member of your local police force if you know somebody would throw some light on the issue.

Geoff, you may find some useful stuff in this link, particularly the bit about conveyancing when you purchased the field.

Thanks for that Peter. Much in common with my situation. It was a large farm and the family sold up and emigrated to Canada, selling the land in various lots but retaining the sporting rights for the whole area. Another farmer bought the core of the original farm but ran into difficulties and eventually sold the land in bits and pieces, three barns for conversion and a plot on the site of other farm buildings for a new build then eventually the farmhouse so a single property became a hamlet of five with no attachment to the surrounding land. The family in Canada leased out the sporting rights and the people who had it never bothered any of us. My solicitor noticed the situation when we bought the barn and plot but was unable to remove the clause that retained the rights, the new build was done by another solicitor for himself and he failed as well. Somebody moved into the area and took on the sporting lease and then eventually bought the rights from the family in Canada, it is him I am having difficulties with.
probably the simplest solution is to make it clear to the individual that you are quite happy to be a good neighbour if he does the same. but that you wont hesitate , should it become necessary, to make a complaint to the local police every time you see him alone with a gun in his hand that hes threatened to shoot you or has discharged it on your land or near you in an unsafe manner.
just make sure theres no witnesses when you talk to him .

It hit 30 degrees on lottie late morning, thankfully a sea breeze came up a wee while later to cool it off a bit. I looked a right sight, sweating buckets & damp sweaty hair under my sweaty hat, loads of dust stuck to the sun cream with sand stuck to my sweaty legs and in my shoes & T shirt stuck to my back. And the quick dunk under the tap was not one of my best ideas as then I introduced mud to the mix!
Fortunately I didn't have to stop anywhere on the way home and great to hoe & not rake up afterwards - very satisfying to watch them shrivel in front of your eyes.

Glorious here. Breakfast out on the patio. A similar lunch planned for later once a few odd jobs done. There probably wont be many more days like this so not going waste the vitamin D doing non essential Indoor or chores which can wait for a rainy day.
Outdoor cucumbers and the courgettes starting to be overtaken with mildew now but appear to be still producing.
Sad my remaining tomatoes couldn,t have ripened on the vine but only about four stripped off the plants I pulled up have yield to blight ......so far!

Lucky yo Richard P, my greenhouse and it's surroundings are besprinkled with empty hazelnut shells, emptied by the tree rats. They're a bit wary this year as well, so I have been unable to set Desmond at them.

Just been informed by daughter that one sweetcorn on our plot has been broken down and is laying on the ground and cobs taken, also stem next to it has been removed and taken completely.
The danger when people start to believe their own publicity is that they often fall off their own ego.
At least travelling under the guise of the Pa Snip Enterprise gives me an excuse for appearing to be on another planet
