Bit of a dilemma.

The tenant behind me has a thornless blackberry bush which,to say the least,is getting out of hand.It is encroaching onto my site and into my fruit patch so that I have to "lift" it out of the way to pick my fruit.I have asked him nicely,several times,to cut it back but he hasn't done so.Am I within my rights to cut it back and leave the cuttings on his site?I don't want to foster any ill feeling between us but I don't think that communication is one of his great points.

You are allowed to cut anything back that is hanging/growing over but, you should ask if they want what has been cut back…..and not just leave it for them!

Claim you tripped and ask if he's insured for injuries caused by his plants?

Thanks all for your advice and comments.Think that I will cut it back and dispose of it myself and argue about it later-if it comes to that.Amanda who gave the site enlosed it in a cage and when she left took the cage with her.He may be reluctant to replace the cage.We'll see.
